The short version: Use DoodleSpark ForKids to have fun and be creative. A parent or guardian is responsible for downloads and purchases. Your child's drawings belong to your family.
1. About these terms
These Terms & Conditions ("Terms") apply to the DoodleSpark ForKids app (the "App") and this website (the "Site"), provided by DoodleSpark ForKids, based in Cork, Ireland ("we", "us"). By downloading or using the App or Site, you agree to these Terms. If you do not agree, please do not use them.
2. Parents and guardians
The App is designed for children, but it must be downloaded, set up and paid for by a parent or legal guardian (or with their permission). By allowing a child to use the App, you accept these Terms on their behalf and agree to supervise their use as appropriate.
3. Your licence to use the App
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for personal, non-commercial purposes, in line with these Terms and Google Play's terms of service.
You agree not to copy, modify, reverse engineer, resell or distribute the App, or use it in any unlawful way.
4. Your drawings
Drawings and creations made in the App belong to you and your child. We do not claim ownership of them. The App's characters, animations, artwork, software, name and logo belong to us or our licensors and are protected by intellectual property laws.
5. Purchases and payments
- The App may offer optional paid content or features. All purchases are processed by Google Play and are subject to Google Play's terms and payment policies.
- Prices are shown in the App or on Google Play before you buy and include any applicable taxes.
- We recommend turning on Google Play's purchase authentication or Family Link so every purchase requires parental approval.
- Purchased content is linked to your Google account and can usually be restored by reinstalling the App with the same account.
6. Refunds
Refunds are handled by Google Play under its refund policy. If you are a consumer in the EU, you may have a right to withdraw from a purchase of digital content within 14 days; by starting a download or use of digital content immediately, you acknowledge that this right may be lost once supply has begun, as permitted by law. Nothing in these Terms affects your statutory rights. If you have any problem with a purchase, please contact us.
7. Advertising
The App may display child-appropriate, non-personalised ads. Please see our Privacy Policy to learn more.
8. Updates and availability
We may update, change or remove features of the App from time to time to improve it or for legal or technical reasons. We aim to keep the App available but cannot guarantee it will always be error-free or uninterrupted.
9. Our responsibility to you
The App is provided "as is" to the extent permitted by law. We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for business losses. Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or fraud, and nothing affects your rights as a consumer under Irish and EU law.
10. Ending use
You can stop using the App at any time by uninstalling it. We may suspend access if these Terms are seriously broken.
11. Privacy
Our Privacy Policy explains how we handle information, including our commitments around children's privacy.
12. Changes to these Terms
We may update these Terms from time to time. We'll update the "Last updated" date above, and for significant changes we'll let you know through the App or Site. Continuing to use the App after changes means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of Ireland. Disputes will be dealt with by the courts of Ireland, but if you live elsewhere in the EU you may also bring proceedings in your home country and rely on its mandatory consumer protection laws.
